Reservations at the Schloss Montfort Restaurant

1. Scope

1.1 These General Terms and Conditions: Reservations (hereinafter: Conditions) of [operating company Schloss Montfort, address] apply – subject to deviating agreements in individual cases – to contracts for table reservations and hospitality in the Restaurant Schloss Montfort (hereinafter: Restaurant) with our guests and contractual partners (hereinafter: Guests).

1.2 Conflicting terms and conditions of our guests are only binding for us if they have been expressly accepted by us in writing.

1.3 We reserve the right, particularly for groups of 25 people or more or in the case of an exclusive booking of the restaurant, to conclude a separate event contract with the client, which will stipulate additional terms and conditions for the duration of the event as well as its preparation and follow-up.

2. Binding nature of the table reservation, conclusion of contract

2.1 Menus, posters and representations on websites that present food, drinks and other services of the restaurant are not legally binding offers, but merely represent an invitation to submit an offer.

2.2 The restaurant serves only high-quality food. The necessary ingredients are purchased fresh daily based on the reservations received, and in the event of a no-show, only a very limited number of items can be reused.

2.3 By reserving a table, you are making an offer to appear at the restaurant at the time of the reservation with the specified number of participants and to order food and beverages. A binding contractual relationship is established upon the restaurant's confirmation of the reservation.

2.4 If a menu selection is specified or limited in connection with the reservation (e.g., a menu for groups), a binding catering contract is concluded upon confirmation. The restaurant reserves the right to make a menu selection in accordance with this clause a prerequisite, particularly for groups of 10 or more people.

3. No right of withdrawal

Even if you are a consumer, you have no right of withdrawal with regard to table reservations or catering contracts according to Section 312g Paragraph 2 No. 9 of the German Civil Code (BGB).

4. Services of the restaurant and guests, prices

4.1 We provide guests with the reserved tables and/or seats and provide the agreed-upon service. There is no right to a specific table. During peak times, waiting times may occur, which we keep to a minimum.

4.2 Guests are obligated to pay the agreed or applicable prices for food, beverages, and other ordered services. This also applies to services ordered in advance (e.g., cake orders, floral decorations).

4.3 We reserve the right to accept a reservation only upon deposit of credit card details or advance payment. In the event of a cancellation, we may be entitled, in accordance with Section 6, to charge the credit card fees or retain the advance payment.

4.4 All prices include statutory VAT. Billing is in euros (€).

5. Withdrawal by the restaurant

The restaurant is entitled to withdraw from the contract if:

  • an agreed advance payment is not made even after setting a deadline;

  • force majeure or other circumstances beyond our control make the fulfilment of the contract impossible;

  • Reservations are made using false information (e.g. about the person or the purpose);

  • there is a suspicion that the reservation may jeopardize the business operations, safety or reputation of the restaurant.

Claims for damages only exist in the event of intentional or grossly negligent conduct on the part of the restaurant.

6. Cancellation by the guest, no-show

6.1 Reservations for up to 5 people (without pre-ordered additional services) can be canceled free of charge at any time. Groups of 6 or more people can cancel free of charge up to 24 hours before the scheduled appointment. We recommend submitting a written cancellation by email to [Email Schloss Montfort].

6.2 If a cancellation occurs at short notice and the table can be allocated to someone else, no costs will be incurred.

6.3 If the guest does not cancel in a timely manner or does not appear at the agreed time (“no-show”), the restaurant may claim a flat-rate compensation.

6.4 For groups of 6 or more people, the cancellation fee per participant is €100.

6.5 Guests reserve the right to prove that less or no damage has occurred.

7. Liability of the restaurant

7.1 We are liable exclusively for damages caused by intent, gross negligence, or culpable breach of essential contractual obligations. In cases of simple negligence, liability is limited to typical, foreseeable damage. Liability for damage to life, limb, or health remains unaffected.

7.2 Strict liability pursuant to Section 536a (1) of the German Civil Code (BGB) for material defects already existing at the time of conclusion of the contract is excluded.

9. Choice of law, place of jurisdiction, EU dispute settlement

9.1 Es gilt ausschließlich das Recht der Bundesrepublik Deutschland.

9.2 The exclusive place of jurisdiction for merchants and legal entities under public law is [location of registered office: Schloss Montfort].

9.3 Note according to EU regulation: The EU provides a platform for online dispute resolution ( http://ec.europa.eu/consumers/odr/ ). However, Restaurant Schloss Montfort does not participate in dispute resolution proceedings before consumer arbitration boards.
